Introduction to Privacy Policy

Transpoints is an application (hereinafter referred to as an “App”) developed by Transpoints Technologies Private Limited, a company incorporated under the Companies Act, 2013 with its registered office at N-10/69 Barasat Road, Barrackpore, Kolkata - 700122, N24PGS, West Bengal, India hereinafter referred to as Transpoints. We value the trust you place in us & respect your privacy. Hence, we maintain the highest standards for secure transactions and user information privacy. Please read the following statement to learn about our information gathering and dissemination practices.
By downloading/using/accessing the Transpoints application as defined for business and/or personal use, you(“User”) indicate that you understand, agree and consent to this privacy policy. You hereby provide your unconditional consent or agreements to Transpoints (including but not limited to Transpoints Technologies OPC Private Limited) as provided under the information technology act, 2000 and the rules and regulations made under therein for accessing any of the Transpoints Applications.
This privacy policy is a legally binding contract between You (“User”) and the Transpoints (collectively referred as “Transpoints Technologies OPC Private Limited” and it’s Group/Associates/Subsidiaries, “We”, “Us”). The terms of this privacy policy will be effective upon your registration on Transpoints Applications (as defined below) and will govern the relationship between you and Transpoints for your use of the Transpoints Applications. This Privacy Policy shall be read together with the respective terms of use or other terms and conditions of the respective Transpoints’s product offering on Transpoints Applications. This document is published and shall be construed in accordance with the provisions of the information technology (reasonable security practices and procedures and sensitive personal data or information) rules, 2011 under the information technology act, 2000; that require publishing of the privacy policy for collection, use, storage, transfer/ disclose of personal information including sensitive personal information. This privacy policy does not require any physical, electronic, or digital signature.

By downloading this app you agree to be bound by the terms and conditions of this Privacy Policy. As this Privacy Policy enables us to provide you a secure and wholesome experience and Privacy Policy forms part and parcel of the Terms of Use and other terms on the App (Terms of Use), we will not be able to register you, if you are not in agreement with these terms. Though every effort would be made to keep you aware of any changes to the Privacy Policy, you are kindly advised to review the policy periodically on the App/Website (“transpoints.in”) to ensure that you are aware of the latest version.
By mere use of the App or having access to any Transpoints Applications or Transpoints Services, you expressly consent to our use and disclosure of your personal information in accordance with this Privacy Policy.

 

Definitions:

“Transpoints Applications” - Refers to any Applications owned/subscribed/used by Transpoints Technologies OPC Private Limited or any other Transpoints Entities not limited to websites, mobile applications, devices, URLs/links, notifications, chatbot, or any other communication medium used by Transpoints Entities to provide its services to its Users.
"Transpoints Service" shall include all services extended / to be extended by Transpoints and Transpoints Entity as a group including but not limited to Pre-Paid Instruments, Payment Aggregator, Payment Gateway, Insurance, Mutual Fund, Gold sale & purchase, Bill payment & recharge, Assisted Banking Services along with all other Fintech services, switch including others.
“Cookies” - “Cookies are small files placed on your device hard-drive/storage that assist us in providing our services. We offer certain features that are only available through the use of a "cookie".
"Session Cookies" - These are temporary files that are automatically deleted from your device hard-drive/storage at the end of a session.
“Business Partners” – Shall refer to any individual, group of individuals defined under law with whom Transpoints or Transpoints Entities have a contractual relationship not limited to Merchants, Advertisers, Deal partners, Financial institutions.
“Service Providers” – Refers to any individual, group of individuals defined under law whose services are used by Transpoints or Transpoints Entities in order to provide the intended services to You through Transpoints Applications.

 

Amendment of Privacy Policy

Our Privacy Policy is subject to change at any time without notice and the same shall be updated and available within Transpoints App and on its website at www.transpoints.in from time to time. Though every effort would be made to keep you informed of the changes, if any, to the policy, you are kindly advised to review the policy periodically. Any changes to the Policy will become effective upon posting of the revised Policy on the Internet, accessible through Transpoints Applications only.

 

Scope & Applicability

This Privacy Policy is applicable to all users of Transpoints including merchants, customers, business partners whether registered or non-registered accessing, offering, selling or purchasing products or services on the website, mobile applications, links, notifications, short messaging services, or any other communication medium used or owned by Transpoints Technologies OPC Private Limited (Transpoints Applications).
Transpoints has permitted its Transpoints entities to use the Transpoints websites, applications, and other communication platforms/applications (Transpoints Applications). This Privacy Policy is also applicable to Transpoints’s Group/Affiliate/Subsidiary Companies defined as Transpoints Entities who provide their products/ services on the Transpoints’s website and mobile applications or control Transpoints directly or indirectly.

 

Purpose

We collect, process, store, transfer and record Your data and information while You visit any of Transpoints Applications or avail Transpoints Services. This Privacy Policy is provided to familiarize You with;

  1. The type of information that is provided or shared by “You” for availing products and services provided on Transpoints Applications and the information that “Transpoints Entities” and “service providers” collect from you;
  2. The purpose of collection of such data and information from “You”. and how “We” intend to use the data provided and collected by “Us”;
  3. Our policy on sharing and transferring your data or information with/to “Service Providers”, “Business Partners”, and “Transpoints Entities”;
  4. The information security practices followed to secure your data and information including data/information retention and destruction policy;
  5. To make you aware of data/information handling disclosures, and “Your” rights.

 

Information Collection

By providing us Your Information or by making use of Transpoints Services provided by Transpoints App or Transpoints Applications, You hereby consent to the collection, storage, processing, disclosure and/or transfer of any or all of Your Personal Information (as defined below), Sensitive Personal Information (as defined below) and Non-Personal Information (as defined below) by Transpoints Entities, as specified under this Privacy Policy.
Our primary goal in doing so is to provide you a safe, efficient, smooth and customized experience. This allows us to provide services and features that most likely meet your needs, and to customize our Website/Application to make your experience safer and easier. More importantly, while doing so we collect personal information from you that we consider necessary for achieving this purpose.

Personal Information - any information that relates to You, which, either directly or indirectly, in combination with other information available can identify You as a person. Your personal information shall include but not limited to the following –

  • Your name, parent’s name, address, telephone number, e-mail address and other demographic information
  • Your date of birth, gender, and marital status
  • Any other information provided by you as part of “Know your customer” norms as required under applicable laws
  • Information related to transactions processed on Transpoints Applications, excluding payment instrument details

 

Sensitive Personal Information - Data or information of a person means which consists of information relating to:–

  • Password
  • Financial information such as Bank account or credit card or debit card or other payment instrument details.
  • Physical, physiological and mental health condition
  • Sexual orientation
  • Medical records and history
  • Biometric information
  • Any information relating to the above points shared by You
  • Any of the information received by Transpoints Entities for processing, stored or processed under lawful contract otherwise.

Provided that, any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as Sensitive Personal Information and may be regarded as Personal Information.

 

Non-Personal Information- We and our Service Providers may collect non-personal data while you access Transpoints Applications via url, smartphones or any other mobile devices. This information shall not identify “you” as a person.

  • The devices and identification numbers of devices used by you to access Transpoints Applications.
  • I.P address and information related to the I.P address.
  • Your geographic location, cookies stored on your browser/devices and behavior on Transpoints Applications.
  • The operating system of your device, browser, browsing behavior and any other data as permitted to be stored by mobile app stores.
  • OTP sent to you by your issuer bank or Transpoints Applications exclusively to carry out transactions on Transpoints Applications.
  • Your messages on message boards, chats or any other message/feedback areas shared on Transpoints Applications and Social Media.

Information may be collected in various ways and formats during the course of your visit or access to Transpoints Applications by way of –

  • Visiting Transpoints Applications.
  • Registering on Transpoints Applications as an “user” or “merchant” or any other relationship that may be governed by terms and conditions listed on Transpoints Applications.
  • Transacting or attempting to transact on Transpoints Applications.
  • Accessing, links, e-mails, notifications sent or owned by Transpoints Applications.
  • Otherwise dealing with any of the “Transpoints Entities”.

We and our Service Providers or Business Partners may also collect information made publicly available through other third-party platforms/applications, through online or offline databases that are otherwise legitimately obtained and are subject to the third party's terms of use and/or privacy statement.
We may automatically track certain information about you based upon your behavior on our App/Website. We use this information to do internal research on our users' demographics, interests, and behavior to better understand, protect and serve our users. This information is compiled and analyzed on an aggregated basis.
We and our Service Providers use data collection tools such as cookies/similar, etc on certain pages of the app/website to help analyze our app/website page flow, measure promotional effectiveness, and promote trust and safety. We offer certain features that are only available through the use of a "cookie".
We and our Service Providers also use cookies to allow you to enter your password less frequently during a session. Cookies can also help us provide information that is targeted to your interests. Most cookies are session cookies, You are always free to decline our cookies if your device permits, although in that case you may not be able to use certain features on the app/website and you may be required to re-enter your password more frequently during a session.

 

Purpose and Use of Information

Transpoints aspires to deliver a safe, efficient, smooth and customized experience. We aspire to provide services and features that most likely meet your needs, and to customize our Website/Application to make your experience safer and easier. Transpoints may collect, use, store and transfer your Personal Information including Sensitive Personal Information and Non-personal information for the following purposes –

  • Verification of your identity, access, privileges assigned in order to provide the services you request, or we intend to offer;
  • To resolve disputes; troubleshoot problems; help promote a safe service; collect money; measure consumer interest in our products and services;
  • To inform you about online and offline offers, products, services, and updates; customize your experience and Improving your experience while using the application by presenting advertising, products and offers tailored to you;
  • To detect and protect us against error, fraud and other criminal activity; enforce our terms and conditions; and as otherwise described to you at the time of collection;
  • To analyze demographic and profile data about our users' activity on our app;
  • To help diagnose problems with our server, and to administer our app. Your IP address is also used to help identify you and to gather broad demographic information
  • Responding to the judicial process and providing information to law enforcement agencies or any government agency in connection with a query/investigation on matters as permitted by law;
  • Allow third parties to contact with You for products and services availed/requested by You on Transpoints Applications or third-party links
  • To identify security breaches and attacks, investigating, preventing and taking action on illegal or suspected fraud or money laundering activities and conducting forensic audits as part of internal or external audit or investigation by any of the Transpoints Entity or government agencies located within India or outside Indian Jurisdictions
  • Sharing, disclosing and transfer of data in case of any major event such as merger, acquisition, sale or transfer of assets in case of any Force Majeure event to any other Transpoints Entity or third party;
  • For data processing, statistical or risk analysis and for analytics and review for improvement of the product/services
  • For designing and marketing, Transpoints products/services and its affiliates products/services;
  • For conducting risk management;

To the extent we use your personal information to market to you, we will provide you the ability to opt-out of such uses.
We identify and use your IP address to help diagnose problems with our server, and to administer our app. Your IP address is also used to help identify you and to gather broad demographic information.
We will occasionally ask you to complete optional online surveys. These surveys may ask you for contact information and demographic information (like zip code, age, gender or interests). We use this data to tailor your experience at our app, providing you with content that we think you might be interested in and to display content according to your preferences.

 

Information Storage and Sharing

Your Personal Information and Sensitive Personal Information shall be stored in electronic form with exceptions, wherein the data is required to be maintained in physical form in information and data centers located within Indian Jurisdictions.
Your data may be collected, stored and processed in countries other than Indian Jurisdictions by Us or our Service Providers as permitted under applicable laws.

  • We shall share personal information with our Business Partners/Service Providers and Transpoints Entities for purposes defined under this Privacy Policy.
  • We shall share personally identifiable information / Sensitive Personal Information provided by you to Business Partners/Service Providers and Transpoints Entities in the course of making transactions.
  • Your data shall be shared with Service Providers that Transpoints work with for services not limited to communication, marketing, data and information storage, transmission, security, analytics, fraud detection, risk assessment, academics.
  • Your data may be shared with the internal investigation department within Transpoints Entities or agencies appointed by Transpoints Entities for investigation purposes located within or outside Indian Jurisdictions.
  • We may disclose personal information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process. We may disclose personal information to law enforcement offices, third party rights owners, or others in the good faith belief that such disclosure is reasonably necessary to: enforce our Terms or Privacy Policy; respond to claims that an advertisement, posting or other content violates the rights of a third party; or protect the rights, property or personal safety of our users or the general public.
  • We and our affiliates will share / sell some or all of your personal information with another business entity should we (or our assets) plan to merge with, or be acquired by that business entity, or re-organization, amalgamation, restructuring of business. Should such a transaction occur that other business entity (or the new combined entity) will be required to follow this privacy policy with respect to Your personal information.
  • We have affiliates around the world. To the extent permitted by law, we may share information with them for specific purposes not limited to investigation or forensics.
  • Information Retention Period - We retain your information for as long as needed or permitted considering the purpose(s) for which it was obtained and will retain this information till such period as prescribed under applicable law.

 

Safeguarding your information

Transpoints Applications are based on the compliance of ISO27001 and PCI-DSS and has deployed technical and physical security measures to safeguard user’s Personal Information and Sensitive Personal Information and undergo strict internal and external reviews to ensure appropriate information security encryption or controls are placed for both data in motion and data at rest within our network and servers respectively.
We have provided multiple levels of security to safeguard your App by Login/Logout option and Application Lock feature (“Enable Screen Lock”) that can be enabled by you. We have preventive controls implemented to ensure you use Transpoints App on your device and same login cannot be used on different device without any additional authentication/OTP. Please do not share your Transpoints login, password and OTP details with anybody.
When you choose to make payment on Transpoints Applications via AadhaarPay, UPI or Cards, some part of your information is stored in compliance with UIDAI, NCPI, RBI and Payment Card Industry Data Security Standard or as per the guidelines of Associate Entity Partner(s).
All Sensitive Personal Information and some part of your Personal Information shall be retained under applicable laws. Personal Information/Non-Personal Information may be retained even after termination of relationship between you and Transpoints Entities.

 

Information Disclosures

Links to Other Platforms/Applications - Our app links to other platforms/applications may collect personally identifiable information about you. Transpoints or Transpoints Entities are not responsible for the privacy practices or the content of those linked platforms/applications. Links to third-party advertisements, websites or any other electronic communication service may be provided on Transpoints Applications, which are operated by third parties and are not controlled by, or affiliated to, or associated with, the Transpoints Entities. Transpoints Entities shall not control the data shared by you on such links and shall be governed by respective third party’s Privacy Policy. You are required to review the third party’s Privacy Policy for handling of your data before sharing your data on such links/websites/apps.

Information Breach - While We shall take all reasonable and appropriate processes and precautions to secure any Personal Information/Sensitive Personal Information which We hold about You, You acknowledge that no data transmission over the internet is fully secure, so we cannot provide any assurance or warrant the security of any information you submit to us.
Review your Personal Information & Sensitive Personal Information - You may review your Personal Information and Sensitive Personal Information shared by You by logging into Transpoints Applications using your secure login credentials and may notify Us in case of any change.
Indemnity - You shall indemnify and hold harmless the Transpoints Entities, their officers, directors, contractors or agents and any third parties relying on the Information provided by You for any losses, including all claims, damages, liabilities, deficiencies, assessments, interest, awards, settlements, penalties, fines, costs or expenses, suffered, incurred, sustained by, or imposed on the Transpoints Entities, as a result of, arising out of, with respect to, in connection with or by reason of a breach or non-performance of any of the terms, conditions, representations or warranties contained in this Privacy Policy by You.
Force Majeure - A Force Majeure Event shall mean any event that is beyond the reasonable control of Transpoints and shall include but not limited to war, riots, fire, flood, acts of God, explosion, strikes, lockouts, slowdowns, prolonged shortage of energy supplies, Pandemic, computer hacking, unauthorized access to computer data and storage devices, computer crashes, acts of state or governmental action prohibiting or impeding Transpoints Entities from performing its respective obligations under the contract.
Jurisdiction - This Privacy Policy is governed by and shall be construed in accordance with the laws of Republic of India and any disputes arising out of or in connection with this Agreement shall be subject to jurisdiction of the Courts of Kolkata, India.
You further agree that such collection, use, storage, disclosure and/or transfer of Your Information shall not cause any loss to any other person. The information so provided by You may be shared to Transpoints Entities and the third-party service provided on a need to know basis.
This disclosure may be required for us to provide you access to our Services, to comply with our legal obligations, to enforce our User Agreement, to facilitate our marketing and advertising activities, or to prevent, detect, mitigate, and investigate fraudulent or illegal activities related to our Services. We do not disclose your personal information to third parties for their marketing and advertising purposes.

 

User Discretion and Opt-In/Opt-Out

You agree and acknowledge that your Personal Information, Personal Sensitive Information and Non-Personal Information out of your free will. You further agree to all the provisions of this Privacy Policy and authorize us to manage the data shared by you or collected by us to be used according to this Privacy Policy.
We provide all users with the opportunity to opt-out of receiving non-essential (promotional, marketing-related) communications from us on behalf of our partners, and from us in general, after setting up an account. If you want to remove your contact information from all Transpoints lists and newsletters, please click on the unsubscribe button on the emailers.
By using the Transpoints Applications and/ or by providing your information, you consent to the collection and use of the information you disclose on the app in accordance with this Privacy Policy, including but not limited to Your consent for sharing your information as per this privacy policy. You also grant permission to obtain information from your mobile device by way of using our app including contacts on your device in order to provide a better payment experience.
If we decide to change our privacy policy, we will post those changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it.

Grievance Policy

We at #Transpoints value the trust placed upon us and strive to offer the best experience to You. Our Grievance policy has been designed to resolve customer grievances in a timely and efficient manner, while treating our customers fairly and courteously.
Our endeavor is to provide You with a seamless experience while transacting via Transpoints App and when required, our in-app customer redressal support process, is able to address all Your concerns. In rare circumstances where, owing to various human, network or system errors, some issues arise requiring a more focused and customized redressal, You may refer to the following redressal mechanism in the sequential order.

 

Grievance Redressal

We have formulated an escalation matrix to ensure that Your concerns are routed and addressed by the right team. You are requested to read and understand the below escalation matrix to ensure a timely redressal of Your concern.
We recommend You to carefully go through our help pages that provide self-help to our customers. For queries and concerns that are not addressed through the help pages, You can contact our customer support team through phone, email or through Transpoints App.
Our in-app support channel can resolve a vast majority of customer complaints. In any uncommon scenario, where You wish to escalate the concern to next level, You need to ensure that You have already exhausted the previous level(s) and Your concern remains un-resolved or not resolved to Your satisfaction.

 

Level 1

Complaints Registration:

  • You can register your complaint with Transpoints Customer Support by clicking on the icon on the home section of Transpoints App. Alternatively, you can raise a support callback request on Whatsapp.
  • We offer customer support service from 10:00Hours to 18:00Hours everyday except Sundays and Holidays.

Resolution of Complaints:

  • We aim to fulfill our first response within 24 hours of receiving the complaint.
  • We aim to resolve all Your complaints/queries within 2 business days.
  • Resolution of Your complaint may get delayed due to operational or technical reasons. In such a scenario, You will be proactively informed of the timelines during which Your complaint will be addressed.
  • In a few scenarios while the resolution to a complaint is instant, it may take time for it to get reflected in the system. For example, refund approval can be instant, but it may take 3-10 working days to reflect money into the account. Please note that such delays are attributable to banking and other operational issues.
  • Complaints related to ‘fraud and risk assessment’ often take longer to investigate due to involvement of multiple agencies. The resolution time in such cases is dependent on the severity and complexity of the case. You shall be proactively informed of the timelines in such cases.

 

Level 2

Complaints Registration: You can escalate Your concerns if they have not been satisfactorily resolved at Level 1Level 2 escalation will be available only then when the status of Level 1 complain is closed.
Any Level 2 escalation email should contain the following information:

  • Registered Mobile Number or MID
  • Ticket number of the complaint registered by Level 1
  • Details of why the resolutions provided at previous levels were deemed unsatisfactory

Resolution of Complaints:

  • We are committed to provide a first response within 24 hours of receiving the complaint.
  • We aim to resolve all Level 1 complaints within 2 business days. Any delay in the resolution time shall be proactively communicated to you.

 

Level 3
